The Treaty of Waitangi Act 1975 is an extremely important piece of law in New Zealand.
The Act set up the Waitangi Tribunal to enquire into and make recommendations on any claims committed to the Tribunal or to examine and report on any proposed legislation referred to the Tribunal (section 5).
The Tribunal was given the jurisdiction to determine any Maori or group of Maori is or is likely to be prejudicially effected by any law currently in force or by any policy or practice by or on behalf of the Crown or by any act which was done or omitted after the commencement of the Act (section 6).
The Tribunal was given the power to refuse to enquire into any claim if they thought the claim was trivial, frivolous, vexatious or not made in good faith (section 7).
The Tribunal was given this very wide power to comment upon proposed legislation if it was referred to the Tribunal by a resolution of Parliament or by any Minister of Crown.
