Illegally Parked Cars – Had Your Car Towed?
We have probably all had it happen to us. You have parked your car on private property, or over a vehicle entrance or on the bus stop, or in a “Clear Way” at the wrong time.
It costs you $60 - $80 to get your car back. Bummer!
But it is all legal.
We think the law is fairly clear.
If you park without permission on private property then you run the risk of having your car seized and taken away whether or not there are any warnings or signs up to that effect.
The owner of the land is entitled to seize any property, including cars, which are not meant to be on their land. This right flows from a legal right established centuries ago known as “cattle trespass”.
The owner can delegate the authority to seize and tow a Tow company.
The tow firm, acting as the agent of the landowner, it is entitled in law to hold the seized vehicle until all reasonable tow and storage charges have been paid. This right was-
