An assault is the legal term used when you hit someone.

 

Sometimes the word “battery” is also used although battery is a term used more in the law in the United Kingdom. In New Zealand we use the term “assault”.

 

If you are the one who has carried out the alleged act of assault, then you can be charged with a number of different kinds of assault of varying degrees of seriousness under the Crimes Act 1961 and under the Summary Offences Act 1981.

 

If you are the victim of an assault you should contact the Police who will decide what offence may have been committed and under what particular section they might decide to charge the offender.

Netlaw replies: Yes, it is possible, but very difficult. There would have to be very special reasons like driving in an emergency situation."

"I was roughly treated at a Police interview. One cop did hit me. It was not that hard but he banged me on the top of the head and yelled that he wanted the truth. It does happen . . not as bad as you see on TV but it does happen. Kevin - North Shore"

Netlaw replies - No, but you do have to pay for a lawyer of your choice UNLESS the case is so serious that it goes to the District Court or the High Court. Then, normal legal aid takes over where you can choose your own lawyer."
