DANGEROUS DRIVING

This site will give you everything you need to know about this very tricky topic.

If you are found guilty of dangerous driving then,  except in very special circumstances, you must be disqualified for a mandatory period of six months.

If you are caught driving at a very excessive speed you might be charged with either driving at a dangerous speed or driving in a dangerous manner or reckless driving.

All of these offences are serious and carry a potential sentence of three months imprisonment and a minimum mandatory period of disqualification of six months.

We can tell you that if you are caught doing more than 50 kilometres above the designated speed limit then you are at real risk of being charged with dangerous speed.

The Police do not have to prove actual danger.

The Police only have to prove potential danger.

A fully defended case involving pleading not guilty and having a lawyer cross examine the Police Officer will be fairly expensive and probably cost you between about $750.00 and $2,000.00    . . .   but get a quote first.

Other speeding offences fall into the category of instant fines.

These fines progressively increase for speeds in excess of 10km/h over the specified speed limit.

The maximum fine is $630 for speeds up to 50km/h over the limit.

If you get an instant fine then read carefully the very small print on the back of the ticket.

You will see that you are invited to write with an explanation to Wellington.

Netlaw replies - No, but you do have to pay for a lawyer of your choice UNLESS the case is so serious that it goes to the District Court or the High Court. Then, normal legal aid takes over where you can choose your own lawyer."
