FINES  .  .  .  BUGGER

We have included a section on fines to give you practical advice about how to avoid getting into deeper trouble for non payment of fines.

We will give you direct access to all relevant sites to visit.  We will also provide you with a full overview of the fines collection system in operation in New Zealand.

We also give you advice about how you might be able to apply for the fines to be wiped or replaced with Community Work.

Click on  Sentencing  in the Related Topics box above and at the end of this topic for a direct link to other helpful topics. to look at the general principles of sentencing.

Two new Acts of Parliament involving sentencing were passed into  law in July 2002.

We suggest you visit our Index Site in our Master Index entitled  Sentencing  to get an overview of the new law.

We can tell you now that there will be a greater emphasis on people being fined rather than having other sentences imposed.

You will that we have covered topics under  Sentencing  and  Parole

We do not know exactly how this will work in practice because many people who come before the Court simply cannot pay fines.

However, we repeat that the emphasis will be more on fines under the new law.

We also point out that, in addition to a fine imposed by the Court, you are ordered to pay $130.00 costs to the Court together with any Reparation order.

It is extremely difficult to have reparation orders ultimately forgiven by the Court or changed into Community Work.

You must realise that Reparation will almost always remain.

You have 28 days to pay your fine or you can apply to the Fines Enfo

"Is it possible to get a discharge without conviction on a dangerous driving or reckless driving charge? Thanks

Netlaw replies: Yes, it is possible, but very difficult. There would have to be very special reasons like driving in an emergency situation."

"Dear Netlaw . . . it was really helpful to realise the difficultes in getting suppression of name and to get some of the caselaw. It allowed me to prepare a lot better. I had a silly shoplifting case but I am in my early thirties and I really wanted name suppression. You guys really helped. Also, you other sites are dazzling. Becs (not my real name)

"WOW . . . a great site. This topic alone is worth the entry fee. I also did my own will and had it checked by a lawyer neighbour and he said it was perfectly OK. Matt G."
"I agree heaps. I actually followed this topic to the letter and got my limited licencemyself. It took a couple of weeks but reckon it could be done in a week. Everything you said happened. The cops were good and the judge was very nice. I only had to mumble "thank you". Noel G.
